    Insurance - Best Practice

Liability Insurance protects the child care provider in the event that they are sued for negligence arising from their activities as a child care provider. Physical injury to a child is the most likely reason for a suit. To be protected from such financial claims, it is advisable to have appropriate and adequate insurance coverage.

Child care providers can be lulled into a false sense of security with the belief that, "The families I provide care for would never sue me". It is important to note that in some cases it may not be the parents who file a lawsuit, but another insurance company, or lawyer. It is good business practice to have adequate liability insurance.

Child care providers generally find that purchasing liability insurance individually is a very expensive proposition. Pacific Child & Family Enrichment Society provides access to a group liability policy plan designed specifically for child care providers in BC. Coverage is offered at a much lower rate than would otherwise be possible if you were applying as an individual.

Maintaining regulatory safety standards and completion of annual professional development are factors in determining eligibility.

    The Plan

The insurance company underwriting the liabiity policy is Aviva Insurance Company of Canada.

The policy provides upto five million of liability with inclusive limits of general liability to cover registered child care providers and will cover injuries, accidents or property damage 'deemed' to be caused by the negligence of the child care provider. (Please note that negligence is assigned by the courts, rather than by personal opinion)

Child care providers are covered under most circumstances, however, the insurance may not respond in the event of actions such as child abuse, battery and non-compliance with Provincial Laws, Licensing Regulations, or Child Care Resource and Referral Program Standards. (trampolines are not covered under this policy contract)

    Automobile and ICBC

Coverage does not include automobile accidents. It is recommended that you check with ICBC to ensure that you are properly covered before transporting children in your care as vehicle accidents do happen. It is recommended that child care providers have a minimum liability coverage of two million ($2,000,000). A valid driver's license is a requirement.

ICBC estimates that 80% of all children are not buckled up adequately. If you are using a child restraint device (car seat), ensure that you have secured the seat properly and the child is safely harnessed. For more information about car seat checks contact 1-877-247-5551.

    Homeowner's Policy

Child care providers who are homeowners and have insurance coverage for their home and contents should advise their insurance agent that they are doing child care in their home. For those child care providers who are renting, the owner of the building is not responsible for damage or loss due to the operation of a child care facility.

    Sexual Molestation Exclusion

This insurance contract does not include coverage if the caregiver, employee, or volunteer is accused of sexually molesting a child.

    Visiting Children

Providers must remain in compliance with regulations when other children are visiting during the hours of operation. Visiting children are those children that could be sent home at anytime, (e.g. neighborhood children). These children may not be covered by the liability insurance.
